Don't dispute that and actually agree, however when we are dealing with very high level Judicial, DOJ, FBI, CIA & I assume some Military Misconduct, Conspiracy, Sedition & Treason & there is at the very least a reasonable argument to be made that the severity level of offense & the fact that a great many of these individuals reported directly or indirectly to superiors in the previous administration who themselves will be on trial and the potential for judicial bias in favor of the defendants is extremely high unless you impose a rule that any judge who reported to, or ever worked closely with anyone from the administration on trial must recuse themselves from hearing the case, it would seem the only way to ensure impartiality is to use the military justice system. Anyone who abused or violated a military or Top Secret grade secrecy oath would by definition have violated military national secrecy law. Every one of the coup plotters had taken a national secrecy oath. I was also under the impression that high ranking officials in the administration, CIA & State Department, etc also held an equivalency of a military rank depending on their position to establish a clear operational chain of command for in theater liaisons, is that not correct?
Any attempt to use solely civilian federal judges that Trump appointed would rightly be challenged to be shot down by the defense attorneys due to the potential of judicial bias on Trump's behalf. It becomes a catch 22. I would think they would have no choice but to use military justices for all coup plotters out of sheer necessity with all others tried in the civilian courts with appropriate recusals. It becomes a really sticky situation. Treason & Sedition in collusion with foreign nations or combatants have always been tried before military tribunals, have they not? Is this not a well established precedent in this country when high crimes against the state or executive have been prosecuted as demonstrated by the exchange between Graham & Kavanaugh at Kavanaugh's confirmation hearing?
