Quick Civics lesson in US politics: First, it is not proposed legislation - it is published policy
While it won't touch my vaping habits, it really pisses me off they are banning flavored pods under the color of "saving children from nicotine addiction"
For one, tobacco flavor is also attractive to children or none would ever smoke - this will do nothing to curb underage vaping and may encourage kids to smoke cigarettes instead of vaping. Sorry to break it to ANTZ, but vaping among youth did not hit their self-described epidemic levels till they started all their nonsensical anti-vaping campaigns that targeted kids
But secondly, this in just the beginning of the end, as there are several more bad public policy rules that will be affecting the US vape market in the coming months -
Check this out, it is a statement from DHH (speaking for the FDA) published today: Keep in mind ENDS means any vaping product, pods, cigalikes, mods, atomizers, juice, etc.
"On Aug. 8, 2016, all e-cigarettes and other ENDS products became subject to the FDA’s tobacco authorities, including the premarket authorization requirements in the Federal Food, Drug, and Cosmetic Act (FD&C Act). All e-cigarettes and other ENDS products on the market at that time needed to have authorization from the FDA to be legally marketed. However, as an exercise of its enforcement discretion, the agency had deferred enforcement of the premarket authorization requirements. To date, no ENDS products have been authorized by the FDA —
meaning that all ENDS products currently on the market are considered illegally marketed and are subject to enforcement, at any time, in FDA’s discretion."
