Can being the key word. But will he?
Sadly, I find the article title misleading. It sums up how we got to where we are today, but it doesn't suggest a single actionable way for Dr. Gottlieb to "Save E-Cigarettes".
You want my guess? The Deeming regs will stay on the books, but the new administration's FDA will do little or nothing to actually enforce them.

Call it "flexible" rather than "selective", because the TCA does allow for that.
Ahh yes use the correct wording I suppose.
To me if a law is not uniformly enforced it needs to go away.
