Late Thursday evening, the Senate passed a measure (SB 810) that would identify e-cigarettes and vaping products as “tobacco products” and raise the age to purchase any tobacco products — including tobacco cigarettes, dip and chew, as well as e-cigarettes — from 18 to 21.

The legislation says a person “may not sell, deliver, barter, furnish, or give, directly or indirectly, flavored liquid nicotine products to any other person.” Outlawed flavors identified in the measure include “fruit, chocolate, vanilla, honey, candy, cocoa, a dessert, an alcoholic beverage, an herb or a spice, or any combination thereof.”

It is on ti's way to the Gov to sign.

is not the national age 21 now ?
yes but it appears lots of states are making it 21 in their states as well. I am not sure why though.

Also the article i linked is very poorly written, if anyone has a clearer one?

The apparent flavor ban part of the bill is of more concern to me not the age thing.

I can see one reason for states to pass an age thing on vaping/tobacco. It has to do with many/most states requiring those selling tobacco or alcohol products to be the legal age to buy such products.
And the FL bill did officially declare vaping as a tobacco product for the state.

Ie cashiers in KY had to be 18 to sell tobacco products or 21 to sell alcohol.

Sick of states going against federal laws to impose on citizens rights.
If federal law says I can "sell, deliver, barter, furnish, or give, directly or indirectly", then Fla can kma and we'll let fed court rule against its self.

btw, i have some juice im going to pif :D

After looking at actual bill it becomes more clear. apparently this state law replicates the Deeming regs on ejuice. And I think does not take effect until 1-2021.
it will just enable FL to enforce the Deeming regs.



(5)(a) A person may not sell, deliver, barter, furnish, or give, directly or indirectly, flavored liquid nicotine products to any other person. For the purposes of this subsection, the term “flavored liquid nicotine product” means a liquid nicotine product containing a natural or artificial constituent or additive that causes the liquid or its vapor to have a distinguishable taste or aroma other than tobacco or menthol, including, but not limited to, fruit, chocolate, vanilla, honey, candy, cocoa, a dessert, an alcoholic beverage, an herb or spice, or any combination thereof.

(b) This subsection does not apply to the sale, shipment, or transport of any product that receives a marketing order issued by the United States Food and Drug Administration under 372 21 U.S.C. s. 387j.

What a bunch of hosers in FLA - let the feds enforce their own effing laws instead of changing local laws
It's a complete waste of resources (ie: tax dollars) for the state to enforce federal laws :cuss2:

perhaps they can collect fines and such instead of the feds?
I dunno not living in FL or planning on going there I did not read the bill in detail.

Our Governor Ron DeSantis has some sense.

He has gone against everyone in the fake ass "public health" sector in that past over a smokable form of something else.
He forced them to drop any lawsuits the day he took office.

This makes me optimistic that he will go with the Flavor Ban everywhere but vape shops approach that the Federal Government seems to prefer.

But he is not going further than the federal govt. the bill is exempting flavors that pass the FDA and does not take effect until Jan 2021 which is well after the FDA enforcement begins.

So just in case the President decides to undo Deeming or postpone it, they’ve got a backup plan ready to go?

There's lots of laws that are duplicate and selectively enforced. In Illinois there's a $1500 fine for littering and when they collect, the proceeds are split with state and local enforcement agencies. Then there are local ordinances for littering for less but go to the locality directly. Also, there's no statute of limitations on municipal fines. They are there until you die.
