Acting state Supreme Court Justice Gerald Connolly on Friday refused to issue a temporary restraining order on the regulations approved on Sept. 17 by Gov. Andrew Cuomo. Health officials issued them in response to worries that vaping may cause illnesses and that its use is growing among teenagers.

The 90-day emergency regulations ban possession, manufacturing, distribution and sale of all vaping flavors except tobacco and menthol. The ban must then be extended or passed into law. The governor applauded Friday's court ruling, saying he wants to also ban sales of menthol-flavored e-cigarettes.

The Vapor Technology Association and two retailers sued Wednesday requesting the temporary injunction on the regulations.

This is amusing, why?

These fascoleftists are destroying an entire industry, and possibly driving people back into a habit that's ten times more harmful than vaping, based on incomplete and inaccurate information, just to be seen to be "doing something."

If I had to guess, I think that @PoppaVic is cynically laughing at the thought that the outcome could have been any different. Not that it's actually funny. At least I hope so.

Don't kid yourselves. It will be shocking if any of these lawsuits in any of these states accomplish anything except spending some money. Nobody is going to reverse or put a stay on anything. Again, as much as I hope I'm wrong.

The days of vaping as we know it are done. It's just a matter of time. It won't be illegal to vape or anything but what will be left is is crap like Blu, Vuse, IQOS, maybe JUUL and a handful of others maybe

The days of vaping as we know it are done. It's just a matter of time. It won't be illegal to vape or anything but what will be left is is crap like Blu, Vuse, IQOS, maybe JUUL and a handful of others maybe
well i would avoid all those starting with the IQOS Possible hepatotoxicity of IQOS

LMAO not even considering it. I just bought enough nic to last me until im about 90. No way in hell im touching that crap.
Enough RTA's, RDA's, mechs, sqonkers, regulated, unregulated, hell I just bought some DNA chips & YiHi chips and gonna start building my own.

Fuck those idiots in charge. I certainly don't like what's happening and I'm trying to be as active/vocal as possible, but imo the writing has been on the wall for a while now, so im literally prepped for a lifetime ban if that's what it comes down to

i have enough that i could afford to buy me some time as well. by then i will either tapper off or be dead :D

It has? I only restarted vaping a week ago, after a three-year hiatus, but I have kinda more-or-less been keeping one eye open. Until very recently I've seen and heard very little about vaping.

Then, out of the cloudy blue sky [*]: BAM!: "Children" vaping like crazy and people dropping like flies. Just about as quickly: Bans.

I could give it up, again, if I had to, so I'm a bit more moderate [**] in my approach. Got a couple mods, three tanks and some coils for them, and I'm keeping one or two RTAs--for which I have some building supplies. Stocking up on a few juices. Plan to resort to the DIY supply place nearby, should it prove necessary.

Here's a funny ol' thing I've noticed: What's being done to the vaping industry and its customers is very like what the left and the dominant media have been trying to do to gun owners for decades. I see two major differences: 1. Gun owners have the NRA. Like 'em or hate 'em: They're damned effective. 2. When gun/ammo bans look to be a credible threat: Prices go up and availability goes down. Drastically. I'm not seeing that with vaping products. True: Local availability is tightening as vendors allow their inventory to wind down, but there are bargains to be had everywhere. E.g.: BOGO juice and hardware at 25-50% off.

Unfortunately I am not ready to give up nic.

I was a pack a day or more smoker for 23 years. Tried chantix, zyban, patches, gum, I even tried hypnosis, and none of it worked. I even ended up in the hospital for a month with severe pneumonia and that didn't stop me from smoking.

It wasn't until my dad was so worried that he decided to buy me a cigalike a few years ago and the rest is history. Not only was I able to stop smoking completely, but it was kind of easy too. Vaping has literally saved my life, so I wanted to be prepared. Going back to smoking is not an option!

Hell, if I quit vaping tomorrow, then that would be ok too, but I don't see that happening yet, so better have it and not need it then need it and not have it.

Have you guys seen that the ban in NY State was stopped temporarily due to some legal crap I don't understand??? Untill like 10/14 I think. !!!!!!

My cousin lives in NY and in the last yr kicked cancer sticks because of seeing me vape for the passed almost 6yrs...she is devistated.....I'm so sad for her....

This afternoon, the New York State Appellate Division granted a temporary restraining order in the lawsuit brought by the VTA, Benevolent ELiquids Inc., and Perfection Vapes, regarding the proposed flavor ban in New York State, which was set to be enforced tomorrow, October 4, 2019. The Order entered by four appellate judges ruled that the State is “temporarily enjoined and prevented from enforcing” the flavor ban until a ruling on the motion for a preliminary injunction is determined. That motion is scheduled to be heard on October 18, 2019.

all hopes for the motion to be in Vapes favor if not this will set the precedent for other possible suits

Nope I'm way the hell out here in New Mexico! No bans here yet!!! I just looked at cdc website and they are admitting most of these cases are from THC vaping. There is still cases of just vaping but I bet those are people who don't want to admit to vaping THC to thier employers or parents. Crazy how the news outlets just want to report assuming information to promote public fear instead of putting real information out there. People are vaping THC and dying...

For now we can buy juice from companies outside of NY.

NY can say you can't sell it here but they can't tell me what I can purchase where I want to buy it from. Some vendors have already over reacted by halting sales to NY. The 1st one who said that I responded to their email saying they are jumping the gun and never got a reply. And it is a great Vendor but like the dumbasses who closed when the Deeming Regs started lost years of sales.

Two of my favorite companies won’t ship to NY, so screw ‘em. I’m glad we have some leeway, though. It was crazy trying to stock up for the long haul in two weeks. I’m glad you clued me in, since so many sites were having “ban sales” aimed at states like ours.
